By Disposition no. 03 of 23.01.2023, the Competition Council initiated an investigation upon the complaint of “Teleport Lab” SRL, regarding a possible infringement of art. 11 para. (1) and (2) lit. a) and c) of the Competition Law no. 183/2012 by “Ridetech International” BV, operator of the platforms “Yandex Go” and “Yandex Pro” in Republic of Moldova, manifested through the application of an exclusivity agreement and the application of a differentiated treatment towards commercial partners following the implementation of the rewards program.
Within the investigation, the Competition Council repeatedly requested detailed information regarding the company’s activity, including data about the drivers involved in the rewards and bonus programs, as well as financial indicators. Although the authority granted additional deadlines and reiterated the requests, “Ridetech International” BV repeatedly provided incomplete or delayed responses, and an essential part of the information was not presented even up to the moment of adopting the decision.
The company justified the refusal by invoking obligations arising from Regulation (EU) 2016/679 (GDPR) regarding the protection of personal data, as well as technical difficulties in processing the data. The Competition Council rejected these arguments, retaining that national legislation is applicable to all undertakings operating on the territory of the Republic of Moldova and that the obligation to provide the requested information cannot be conditioned by external norms.
The authority found that the requested information was essential for carrying out the investigation regarding a possible abuse of dominant position and that the failure to present it seriously affected the Competition Council’s ability to exercise its legal powers.
Thus, by Decision no. APD-38 of 20.11.2025, the Plenum of the Competition Council found the infringement by “Ridetech International” BV of the procedural rules provided in art. 68 para. (1) point 1) of the Competition Law no. 183/2012, manifested through the non-presentation, incomplete presentation, and delayed presentation of the information requested within the investigation.
