Friday, July 18, 2014, Mrs. Viorica CARARE, the President of the Competition Council of the Republic of Moldova and Mr. Grigore VARANITA, Director of National Regulatory Agency for Electronic Communications and Information Technology (NRAECIT) has signed a cooperation agreement.
The agreement was signed during the bilateral meeting of the President of the Competition Council and the members of the Plenum of the Competition Council with the administration of the NRAECIT. It establishes the framework for cooperation between the two institutions in order to fulfill legal attributions conferred to parties by law and increase of the efficiency of their actions, related to the specific objectives pursued by each party according to the law.
At the meeting officials from the NRAECIT and Competition Council discussed issues related to the current cooperation between the two institutions, the ways to enhance relations of cooperation and the use of instruments of cooperation provided for in the agreement signed by the parties.
Director of National Regulatory Agency for Electronic Communications and Information Technology, Grigore VARANIȚA declared that NRAECIT is interested in strengthening relations of cooperation with authority for competition protection and relies heavily on its support in promoting regulatory acts stimulating the development of the electronic communications market and ensuring fair competition in the market. I believe that effective communication and exchange of information between parties, mutual consultations on issues of common interest will be of great benefit to both institutions emphasized Director of NRAECIT.
In her turn, the President of the Competition Council, Viorica CARARE, expressed confidence that the agreement signed today will foster collaborative relationships with NRAECIT, relations which in recent years have developed continuously. She noted the importance of effective cooperation between the two institutions in order to prevent and deter anti-competitive practices in the market for electronic communications.
The main aim of the cooperation agreement between the Competition Council and NRAECIT is to foster cooperation activities on the effective enforcement of competition law to prevent and deter anti-competitive practices which have as their object or may have the effect of restricting, preventing or distorting competition. The agreement aims to promote the exchange of information and documents between the parties collaborating in conducting market studies and analysis, mutual consultations on current problems related to the implementation of the law on the competence of the two institutions.
Cooperation between the Competition Council and other regulatory authorities, including NRAECIT, is performed according to the delimitation of functions and powers by law based on the following principle: regulatory bodies ex ante (before) in the regulated sector, and the Competition Council acts ex post (after ) to ensure competition, applying competition legislation to all relations in the national economy which fall under the Competition Law.
