Pursunat the provisions of the Law on Competition no 183 as of 11.07.2012, the notification of economic concentrations (mergers, acquiring the control by acquisition of securities (social parts), etc.) shall be compulsory at the Competition Council, before applying thereof, where the total turnover achieved cumulatively by the undertakings (or group of undertakings) concerned, registered for the year prior to the operation, exceeds MDL 25 000 000 and there are at least two undertakings involved in the operation which achieved on the territory of the Republic of Moldova, each, a total turnover more that MDL 10 000 000.
By implementing an economic concentration until declaring it as being compatible with the competition environment, under a decision issued by the Plenum of the Competition Council, there is the risc of applying sanctions up to 5% from the total turnover, as well annulment of the operation itself.
