By the Decision of the civil , commercial and in contentious administrative enlarged College of the Supreme Court of Justice of October 29, 2014 the appeal filled by the ICS « Red Union Fenosa » JSC was rejected, and in that way the Decision of the Competition Council is left in force.
We would like to mention that the Plenum of Competition Council has qualified as abuse of a dominant position the imposing of free transmission of equipment of SC ,, Magic-Cons “LLC., by the contract conclusion, to the balance of ICS ,, RED Union Fenosa “JSC .
As the grounds for its decision, the Supreme Court reiterated that ICS ,, RED Union Fenosa “JSC, the sole provider of electricity in mun. Chisinau has not complied with the legal provisions in force in the issuing the connection notice, and SC ,, Magic-Cons “LLC because of the urgent need to supply electricity, was forced to accept unfavorable conditions imposed by the provider.
Please note that the Supreme Court decision is final and irrevocable.
