The Competition Council conducts dawn raids at undertakings operating in the market for medical devicesBetween 11 - 12 April 2024, the Competition Council conducted dawn raids at several undertakings operating in the medical devices market. The dawn raids are carried out within the framework of the investigation initiated on the signs of violation of the provisions of Article 5 of the Competition Law, namely the participation with bid rigging to electronic public procurement procedures. Dawn raids represent a stage of the investigation. Their purpose is to identify and collect relevant evidence for the case. The conduct of dawns raids does not imply that undertakings are presumed guilty of engaging in anti-competitive behavior. After the dawn raids have been completed, the collected information will be analyzed to determine other relevant investigative actions. The legislation does not provide for any fixed time limit for completing the investigation procedure. It depends on several factors, including the complexity of the case, the extent to which the involved undertakings cooperate with the competition authority, ensuring the rights of the parties to defense, and ensuring a fair process. The Competition Council will continue to pay special attention to the medical sector, as ensuring fair and honest competition in this field is crucial for the well-being of all citizens of the Republic of Moldova.
