The Competition Council sanctioned two undertakings for participating with bid rigging in public procurement

The Competition Council has sanctioned the "Vigurcom" SRL and "Rapid Link" SRL undertakings for participating with bid rigging in public procurement.


Following an investigation conducted by the Competition Council, it was found that the two undertakings participated with bid rigging in the public procurement procedure organized in 2019 by the Information Technology and Cyber security Service, which aimed to acquire construction works for telephone and communication lines and auxiliary works for several public objects.


In the process of preparing bids for participation in the mentioned public procurement procedure, the involved undertakings exchanged competitively sensitive information and coordinated participation bids, thus violating the legal provisions.


On April 5, 2024, the Plenum of the Competition Council issued Decision No. DA-27/20-06, by which sanctioned the "Vigurcom" SRL and "Rapid Link" SRL undertakings for violation of Article 5 of the Competition Law. The total amount of fines imposed on the two undertakings amounted to 1,918,063.52 MDL.


According to the President of the Competition Council, Alexei GHERȚESCU: "Bid rigging represents one of the most serious infringements of competition law. The national competition authority will continue to monitor public procurement constantly, considering the negative impact any infringement in this area can have on society as a whole. It is essential to ensure the efficiency in the use of public resources in the conditions of a fair and transparent competitive environment."


The Competition Council draws the attention of participants in public procurement to the risks associated with coordinating actions in preparing bids, exchanging information, and involving the same individuals in the bidding process. These practices may infringe Law no. 183/2012 on competition and may lead to the sanctioning of undertakings, in accordance with legal provisions, which prohibit agreements and concerted practices that restrict competition on the market of the Republic of Moldova.
