The Competition Council sanctioned „Bucuria” S.A. with over 1.8 million MDL for illegal copying of confectionery packaging „MU” and „PARKUR”, belonging to another undertaking. The decision on finding the unfair competition actions was taken on 07 June 2024.
The investigation was initiated in 2022, following the complaint lodged by the foreign undertakings manufacturing the similar confectionery products and their official importer in the Republic of Moldova. According to those invoked in the complaint, „Bucuria” S.A. uses chromatic shapes and ranges in the packaging of its products similar to those of the complainant’s products.
As a result of the investigation, the Competition Council found the infringement of Article 19 of the Competition Law by „Bucuria” S. A., which prohibits any actions or facts likely to create confusion with the undertaking, products or economic activity of a competitor.
Also, according to the decision taken, the undertaking „Bucuria” S.A. it was prescribed to cease the unfair competition actions found and to withdraw confectionery products „MU” and „PARKUR” from the market.
Note: The decision can be appealed, within 30 days, in the specialized court. It will be published on the Competition Council website after the confidentiality of personal data or data that constitute a trade secret will be ensured.
