Last week, Mrs Viorica CARARE, President of the Competition Council talked to judges specialized in the commercial litigation , invited to attend the seminar ” Competition Law ” , which was held at the National Institute of Justice on 4-5 and 6 -7 March 2014 .

     During the discussion Mrs. Viorica CARARE stressed that the Association Agreement EU-Republic of Moldova, in addition to reform justice, requires proper implementation of competition law and state aid law- a new field, unknown until now – and one of the objectives of the seminar is to provide information that will be useful in the practice of judges, which handle cases in this field.

    As a trainer at the seminar ” Competition law ” with Paul Urban of the Czech Bar Association, Nicholas CRAIU , Judge at the Court of Appeal Chisinau , and Carolina PARCALAB, attorney in  ACI Partners BAA also assessed Mrs. Valentina Novac, head of Anticartel Department of the Competition Council .

During this Course of the continuous training Mrs. NOVAC spoke about “Legal analysis of anticompetitive agreements in terms of Competition Law of Moldova” and “Control of economic concentrations under the Competition Law of the Republic of Moldova” .

    For four days, they discussed both theoretical aspects of competition law and practical perspective on competition regulations of Republic of Moldova and the European Union. Also has been made a special emphasis on legal standards against the restriction of competition, including rules on cartels, abuse of dominance, and control of economic concentrations. Special attention was paid to enforcement of competition law by national courts and the problems they face during examination of competition disputes, especially – those related to the assessment of the prejudice.

     The course was part of the Program of Restructuring and Retraining of the Commercial Courts and was implemented by the European Bank for Reconstruction and Development (EBRD), in collaboration with NIJ , Wolf Theiss and ACI Partners, financed by EBRD with the generous support of the Czech government .
