The previous week, Mrs Viorica CĂRARE president of the Competition Council talked to the judges specialized in commercial causes, invited to participate at the workshop  Competition Law , which took place in the National Institute of Justice within 4 – 5 and 6 -7  March 2014.

     During the discussion, Mrs Viorica CĂRARE underlined the fact that the Association Agreement EU-Republic of Moldova, besides justice reform, provides for proper enforcement of competition and state aid legislation- a new domain, less known till now- and one of the objectives of the workshop was provision of information which should be useful in the practices of judges while examining cases in the domain at issue.

     The trainers of the workshop Competition Law were Pavel URBAN from Czech Bar Association, Nicolae CRAIU, judge at the Court of Appeal Chișinău, Carolina PÂRCĂLAB, lawyer at BAA ACI Partners and Mrs Valentina NOVAC, head of Anti-cartel Deparment within Competition Council.

     During this training course, Mrs NOVAC spoke about  ĂœLegal analysis of anticompetitive agreements in terms of Moldovan competition law and ĂœControl over economic concentrations pursuant to the Law on Competition of the Republic of Moldova .

     In a four days period, both theoretical and practical aspects of competition law were discussed as to competition regulation from the perspectice of the Republic of Moldova and European Union. The legal norms against competition restrictions were emphasized, including the rules on cartels, abuse of dominance, economic concentrations control. High attention was paid to enforcement of the law on competition by national courts and the problems they face while examining competition disputes, namely- those related to evaluating the prejudice.

     The course was part of the Program of Restructuring and Requalification of Commercial Judges and was implemented by European Bank for Reconstruction and Development (EBRD), in collaboration with INJ, Wolf Theiss and ACI Partners, financed by EBRD with the support of the Czech government.
